“SNIFFING OUT THE PERFECT DOG” CONTEST
OFFICIAL RULES
NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS CONTEST.
1. ELIGIBILITY: This Contest is open only to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older at the time of entry. You need not be present to win. Employees (and their immediate families or those living in the same household) of United Pet Group, Inc. and Bowtie, Inc. (“Sponsors”), and their respective affiliates, subsidiaries, divisions, parent and related companies, suppliers, printers and advertising, promotional and judging agencies are not eligible to enter or win.
2. HOW TO ENTER: Contest begins at 12:01 a.m. EDT on June 1, 2008 and ends at 11:59 p.m. EDT on August 31, 2008 (“Contest Period”). Beginning on June 1, 2008 you may log on to the Dogchannel.com website located at www.DogChannel.com/PerfectCoat and follow the entry directions. You will be required to submit a photograph of your dog along with your name, address, city, state, zip code, telephone number, age, the name and age of the dog in the photograph entry, and e-mail address. Entrant must be the registered subscriber of the is made. In the event of a dispute as to entries submitted by multiple users having the same e-mail account, the authorized subscriber of the e-mail account (as specified by the Internet Service Provider) used to enter the Contest at the actual time of entry will be deemed to be the entrant. All entries must be received by 11:59 p.m. EDT of the last date of the Contest, i.e. August 31, 2008. Illegible, incomplete and duplicate entries will be disqualified. All photographs submitted become the property of Sponsors and will not be returned. Photo submitted must be the original work of the entrant and not subject to any claims of copyright or trademark infringement. Entries become the Sponsors’ property with all rights, including the right to edit, publish, and use without further payment or consideration to entrant and by submitting entry, entrant agrees to execute any documents requested by Sponsors to vest ownership of such rights in Sponsors.
3. PRIZES AND APPROXIMATE RETAIL VALUE: There will be three (3) Grand Prizes awarded. Each Grand Prize consists solely of having a photograph of Winner’s dog appear on the label of a Perfect Coat Shampoo product at some time during 2008 or 2009, as determined solely by Sponsors. Each Grand Prize Winner will be invited to attend a professional photo shoot with their dog and a photograph from the photo shoot will appear on a product label. The time and place of the photo shoots will be arranged solely by Sponsor and reasonable efforts will be made to schedule the photo shoots at locations and times that are convenient for Grand Prize Winners. However, if Grand Prize Winner cannot be present for photo shoot as arranged by Sponsors, Winner will forfeit the prize and an alternate Winner selected. If Prize is forfeited, Sponsors will have no further obligation to Winner. There will also be five (5) Runner-Up Prizes awarded. Each Runner-Up Prize consists solely of a gift basket containing Perfect Coat grooming products worth approximately $150. All Winners will be selected on or about October 1. 2008 based on the quality, clarity and suitability of the photograph they submit as determined solely by the judges selected by Sponsors, whose decisions are final and binding in all matters relating to this Contest. The Winner will be notified by telephone, e-mail or mail service by October 8, 2008. No transfer, substitution, or cash equivalent for the Prize permitted, except by Sponsors in their sole discretion. The Prizes are guaranteed to be awarded. Only one Winner per household is permitted.
4. PRIZE CONDITIONS: Winner will be required to execute and return an Affidavit of Eligibility/Release of Liability/Publicity Release within fifteen (15) days of issuance. Failure to return all required documents in this time period may result in the Winner being disqualified and an alternate Winner selected. If a prize notification is returned to Sponsors as undeliverable or if an entrant is found to be ineligible or declines acceptance of the Prize for any reason, an alternate Winner will be selected. By entering this Contest and/or accepting the Prize, Winner and entrants hereby consent (except where prohibited by law) to the reasonable use by Sponsors of the Winners’ and entrants’ photograph, voice, likeness and/or image, 4690574.1 - 2 - hometown address, contents of the entry form, including the photograph of Winner’s and entrant’s dog and the name and age of the Winner and entrant without any further compensation for any future promotional activity related to this Contest or similar promotions operated by Sponsors. You must have all ownership rights to the photograph you submit. Your photo must be an original and show only one pet.
5. CONDUCT OF PARTICIPATION: By entering the Contest, entrant affirms that he or she has read and agrees to abide by the Official Contest Rules and the decisions of the judges. Sponsors reserve the right to disqualify any entrant acting in violation of the Official Rules or found tampering with the entry process or with the operation of the Contest or the website. The Contest is governed by the laws of the United States and, by entering, all Winners and entrants hereby submit to the jurisdiction and venue of the federal, state and local courts located in St. Louis, Missouri. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE RELATED TO SPONSORS OR THE CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
6. RIGHT TO USE ENTRY SUBMISSION: Entries, including photographs, become the property of Sponsors. By submitting your entry, you irrevocably assign all rights, titles, and interest in your entry and photograph in any and all media whether now known, devised, or in perpetuity anywhere in the world, with the right to make any and all uses, including without limitations for purposes of advertising or trade. The rights granted in this paragraph shall extend to all entries and all other submitted materials, including photographs, related to the contest, including those submitted by winners and non-winners.
7. LIMITATIONS OF LIABILITY: Sponsors and each of their respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, are not responsible for any incorrect or inaccurate entry information, theft, tampering, destruction, or unauthorized access to, or alteration of entries; printing or other errors; and any entries or mail which are late, lost, delayed, incomplete, misdirected, stolen, mutilated, illegible, postage due or any combination thereof. Sponsors reserve the right to modify, suspend or terminate the Contest in the event that it becomes necessary due to circumstances beyond Sponsors’ control. In the event the Contest is terminated early, a winner will be selected from all eligible entries received at the time of termination.
8. RELEASE OF LIABILITY: By participating, Winner and entrants agree to release, discharge, indemnify and hold harmless Sponsors and each of their respective affiliates, subsidiaries, parent corporations, and their officers, directors, employees, representatives and agents from and against any claims made by the Winner, entrants or any other third parties related in any way to the operation of this Contest, as well as any other claims, damages or liability due to any injuries, damages or losses (whether alleged, threatened, or actual) to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest.
